Intellectual Property.  Develop and implement business-focused U.S. and foreign IP strategies.  Advise clients regarding requirements of patentability, scientific and legal strategies for supporting patent applications, trade secrets, licensing and trademark applications.  Advise clients regarding domestic and international intellectual property implications of business decisions, licensing, contracting and litigation.

 

Scientific Consultation: Experimental design and implementation; evaluation of methods and results.  Medical therapy and therapeutic standards in physiology, pharmaceuticals, molecular diagnostics and genetic markers of disease

 

Patent Drafting: Drafting and filing provisional and utility patent applications, PCT and non-PCT foreign patent applications. Drafting patents relating to therapeutics including antisense, immunology, analytical methods, pharmaceuticals, bioinformatics, chemicals, medical devices, medical and semiconductor polymers, manufacturing processes, methods of use, semiconductor processing equipment for polymer deposition and manufacture, organic and inorganic chemistry, superconductors, information technology and software, oncogenes, nucleic acids, oncogene products; methods of use: immunoassays, antisense and antibody therapy, diagnostic methods, mechanical inventions, consolidation of applications and claim drafting.  

 

Patent Prosecution:  Biotechnology, chemical, pharmaceutical, bioinformatics, software, medical device, immunological, mechanical, superconductivity and semiconductor patent prosecution: drafting amendments relating to cellular uptake, efficacy of antisense nucleotide therapeutics, bio-polymer chemistry, semiconductors, medical chemistry.  Preparation of Information Disclosure Statements.  Drafting declarations and petitions supporting patentability. Drafting Opposition documents for foreign prosecution.  Consultation with foreign associates. Over 100 patents issued

 

Legal Opinions: Research and preparation of legal opinions regarding joint ventures, non-infringement and invalidity; due diligence analysis of patent applications, patents and patent portfolios. 

 

Contracts and Licensing: Negotiate and draft purchase and resale agreements, confidentiality agreements, employee agreements, consulting agreements, technology transfer and licensing agreements.  Evaluation of technical and legal services and due diligence.  Over 50 Licenses and Agreements and 12 validity or non-infringement opinions prepared.

 

Trademarks: Drafting, prosecution, and maintenance of trademark and service mark applications and registrations in United States and in foreign countries.

                                   

Dispute Resolution: Legal research and analysis, preparing motions and memoranda of points and authorities, filing court documents, court appearances, mediation and arbitration; draft cease and desist letters.
